Epistol is a digital publishing company operating out of Tavistock Street, WC2E 7PB, London, United Kingdom. In using its website, www.digepistol.com, you agree to be bound by these terms and conditions, whether a casual visitor (meaning one who browses the site and its contents), a paying subscriber (meaning one who enters into a paid subscription agreement with Epistol via its website www.digepistol.com in order to access premium content - this functionality is not yet operational), or a writer who has submitted works for consideration for publication (writers are asked to agree and conform to a more fulsome set of agreements upon uploading their work via the submissions registration tool). 

'You' in this agreement refers to all parties listed above, and you are only authorized to use www.digepistol.com if you are in agreement with and abide by all terms stipulated in this document. Use of www.digepistol.com in any of the aforementioned capacities implies that you have read, understand and accept all terms, and will be legally bound by any deviation from them. If you are not in acceptance of these terms and conditions, we ask you to click away immediately from www.digepistol.com (try here, for example: www.cuteoverload.com).

From time to time, we might modify this agreement and any such modifications will be effective immediately.

Epistol reserves the right to reject any materials submitted for publication as well as to restrict the access of any visitor at any time without notice.

Eligibility for use of www.digepistol.com in any capacity is not restricted to persons of any age. We do not take responsibility for the use of this website by minors, or attempt to control their elective accessing of materials which might be deemed provocative or damaging by any local laws.

This agreement will remain in effect throughout your use of the website. Submitting authors may terminate or withdraw their agreement by contacting query@digepistol.com with the reference code of their submission and a clear subject line instruction of "DESIST".

When you sign up to the Website as a submitting author or as a paid subscriber, you will be asked to choose a password. It is your responsibility to maintain the confidentiality of this password and you agree not to share this password with anyone at any time.

For whatever reason, there might be occasional service interruptions or errors in transmission on or from www.digepistol.com. Whilst we take responsibility for this, we accept that this is due to the nature of the internet and thus we do not accept any liability for any distress these errors or interruptions might cause.

Epistol at www.digepistol.com does not claim any right of ownership on any manuscripts submitted or published via our website. We similarly do not claim any right of ownership over any user-generated content. After submitting your work to Epistol, including if it is published, you will retain all intellectual property ownership rights and you have the right to use your content in any way you choose; we do ask that if your published work is taken by another publishing company (specifically traditional print publishing) you withdraw your work from Epistol in order that our hosting of this content and commercializing of it does not put us in any legal difficulty. Furthermore, you accept that www.digepistol.com operates as an agent and distributor of your work only, and that you are responsible for disclosing any conflicts of territorial rights to the work proposed.

By submitting your content to us you hereby grant us (www.digepistol.com) a license to reproduce and distribute this content via sales on the website. This license is non-exclusive. You license this personally and agree not to use an agent, lawyer or any other manager in attempt to negotiate fees and terms, which are fixed for all published authors. This license grants us the right to sell your content on your behalf at a pay rate of 55% to you and 45% to be retained by Epistol in order to cover all overhead, including VAT, PayPal fees, etc. Submitting authors agree that payment of commissions will be done via PayPal on a monthly basis. Epistol waives any responsibility for the payment of any income tax or social insurance schemes. Published authors based in territories other than the United Kingdom accept that payment will be made in GBP.

You accept sole responsibility for the content submitted by you, and represent that you own the content and have the right to submit it for publication and distribution across all territories from the hosting site in London, United Kingdom. You represent and accept responsibility for also that your work does not infringe any privacy rights, publicity rights, intellectual property rights or any other rights of any individual. You represent that this content is in no way libellous or obscene or does not in any way breach any official secrets acts where enforceable.

You agree to indemnify www.digepistol.com against any damage or expense or loss suffered or incurred as a result of your being in breach of any of the above clauses as agreed with us.

From time to time you might need to download software and content from other suppliers in order to fully utilize www.digepistol.com. In these instances, you might be subject to additional terms and conditions. You accept that these additional clauses will then be incorporated into this agreement.

You also accept that Epistol at www.digepistol.com will not be liable to you for any delay or other failure to comply with our obligation if this delay or other failure arises from anything which is beyond our reasonable control.

All users of www.digepistol.com agree not to distribute or copy any intellectual property contained therein, or make use of this property without proper citation in any capacity. This includes downloading and forwarding purchased materials via email or any other means, including printing and making copies. All users agree that doing so will constitute an act of theft and are bound by law not to do so. This also includes the redistribution of these materials for commercial gains.

The agreement laid out in these terms and conditions represents the entire agreement between Epistol and user, exclusive of any implied terms.

This agreement shall be governed by and construed in accordance with English Law and you agree to submit to the exclusive jurisdiction of the English Courts.
